Can you claim HRA without rent receipts?

Only in limited cases. Employers have long been allowed to accept HRA claims of up to ₹3,000 a month without rent receipts. Above that, you need proof that you actually paid rent: receipts, a rent agreement, and bank or UPI records. HRA exemption is available only under the old tax regime, and a tax officer can still ask for proof.
This is general information, not tax advice. Tax rules change, and how they apply depends on your situation. It has not yet been reviewed by a chartered accountant. Have a chartered accountant (CA) check it for your situation before you use or rely on it.
When rent receipts are not needed
CBDT circulars on tax deduction from salary let employers skip rent receipts for employees whose HRA is up to ₹3,000 a month (ClearTax, citing Circulars 8/2013 and 20/2015). Two limits apply:
- It is a payroll concession, not an exemption from paying rent. The circular says it applies only to tax deducted by the employer, and the Assessing Officer can still ask whether you really paid rent (Business Today).
- Check that it still applies. The Income-tax Act, 2025 and the Income-tax Rules, 2026 apply from 1 April 2026, and we could not confirm that a new circular repeats the ₹3,000 concession. Ask your employer's payroll team.
Proof that works when you have no receipts
The claim rests on one fact: you paid rent for a home you lived in. Receipts are the usual proof, but they are not the only one. If you have none, gather as much of this as you can:
| Evidence | Why it helps |
|---|---|
| Bank transfer or UPI records to the landlord | Shows the amount, date and who received it, every month |
| A signed rent agreement | Shows the rent, the address and that you were the tenant |
| The landlord's PAN, or their written declaration if they have none | Needed once rent is above ₹1,00,000 a year; lets the department match the landlord's income |
| Utility bills, a gas connection or a bank statement at that address | Shows you actually lived there |
| Messages with the landlord about rent | Supports the dates and amounts |
Even if you paid by UPI, ask the landlord for receipts now, for the months already paid. The free rent receipt generator makes one receipt for every month in a period, with the landlord's PAN line when it is needed. Your landlord only has to check the details and sign.
What if your employer did not count your HRA?
If you missed the payroll deadline or had no receipts then, the employer will have taxed your full HRA. You can still claim the exemption in your income tax return, as long as you choose the old tax regime and keep the proof above. Under the new regime, which is the default, all HRA is taxable (ClearTax).
Work out the exempt amount first: it is the lowest of the HRA received, the rent paid minus 10% of basic salary and DA, and 50% or 40% of that salary depending on the city. The HRA exemption calculator does this for FY 2026-27 and FY 2025-26.
Never make up rent receipts
Receipts for rent you did not pay, or receipts in a relative's name for a home they do not own, are misreporting of income, and the landlord's PAN lets the department check your claim against their return. A claim that cannot be proved can be disallowed with tax, interest and a penalty. This page is general information, not tax advice; check your case with a chartered accountant.
Paying rent but getting no HRA: section 80GG
If your salary has no HRA, or you are self-employed, you may be able to deduct rent under section 80GG of the 1961 Act, which ClearTax maps to section 84 of the Income-tax Act, 2025. The deduction is the lowest of three amounts (ClearTax):
- ₹5,000 a month, or ₹60,000 a year
- 25% of your total income, before this deduction
- Rent paid minus 10% of your total income
It is available only under the old regime. You, your spouse or your minor child must not own a home where you live or work, and you file a declaration, Form 10BA under the old rules, before your return. The form under the 2026 rules may differ, so check on the income tax portal. Receipts and payment records are just as important here.
Make receipts automatic next year
From tax year 2026-27, employees declare HRA and landlord details to the employer on Form 124, which replaces Form 12BB (Income Tax Department, Form 124 FAQs). A receipt for every month makes that declaration simple. If you pay rent to a parent, read our guide to a rent receipt for rent paid to parents.
Ask your landlord about Domvio
When a landlord uses Domvio, every rent payment the landlord confirms, UPI or cash, sends a PDF rent receipt to both sides on WhatsApp, so there is a receipt for each month without asking. It is free for landlords during early access; see the rent collection app.
Frequently asked questions
Can I claim HRA without rent receipts?
Your employer may accept HRA up to ₹3,000 a month without receipts. Above that, you need proof of rent paid, such as receipts, a rent agreement and bank or UPI records, and you must be on the old tax regime.
Is a bank statement enough for an HRA claim?
It is strong proof of payment, but most employers still ask for receipts, and above ₹1,00,000 a year you also need the landlord's PAN. Get receipts signed for the past months; the rent receipt generator makes them in one go.
Can I claim HRA in my ITR if I did not submit receipts to my employer?
Yes, under the old regime, if you really paid rent and keep the proof. Work out the exempt amount with the HRA exemption calculator.
What if my landlord refuses to give rent receipts?
Pay by UPI or bank transfer so every payment is on record, keep the rent agreement, and note the landlord's PAN from the agreement if rent is above ₹1,00,000 a year. Ask a chartered accountant how to present the claim.
Can I claim both HRA and 80GG?
No. Section 80GG is only for people who receive no HRA at all during the year.
