Late fee on rent in India: is it enforceable, and how much is reasonable?

A late fee on rent is enforceable in India only if the rent agreement provides for it, and even then a court allows only reasonable compensation under section 74 of the Indian Contract Act, 1872. A modest fee after a grace period is easier to defend than a large penalty. The calculator works out what your clause charges.

This is a sample for general information, not legal advice. Laws differ by state. It has not yet been reviewed by a lawyer. Have a lawyer examine it for your situation before you use or rely on it.

Late fee calculator

Enter the rent, the due date and the day it was paid, then what your agreement says about late payment. The result shows the fee, what share of the rent it is, and what it would be as a yearly interest rate, with the matching clause in words.

This calculator needs JavaScript. By hand: days late minus the grace period gives the days charged; multiply by a per-day fee, or take the fixed fee or the percentage of rent once, up to any cap.

The note that a charge looks large (above 10% of a month's rent) is our own rule of thumb to prompt a second look. It is not a limit set by law.

Can a landlord charge a late fee on rent in India?

  • Only if the agreement says so. We found no central law that sets a late fee on residential rent. Without a clause, you can claim the unpaid rent, but you cannot add a fee afterwards.
  • A court allows reasonable compensation, up to the amount agreed. Section 74 of the Indian Contract Act, 1872 says that when a contract names a sum payable on breach, the other side gets reasonable compensation not exceeding that sum, whether or not actual loss is proved (text and illustrations).
  • A big step-up can be a penalty. The section's explanation says a stipulation for increased interest from the date of default may be a penalty, and its illustration (d) treats a jump to 75% interest on default as one, allowing only what the court thinks reasonable.
  • The Model Tenancy Act does not add one. The PRS summary of the model Act lists no late fee; its money remedies are for tenants who overstay (PRS).

A late fee does not let you evict sooner

Charging a fee does not change the notice or the court route for unpaid rent, and you cannot hold back the tenant's belongings, lock them out or cut supplies to collect it. See landlord rights in India.

Sample late fee clauses for a rent agreement

Three common shapes, written plainly. Pick one, fill the numbers, and have a lawyer check it with the rest of your rent agreement. Name it as an estimate of your loss, not a punishment.

Fixed charge after a grace period (sample)

If the rent is not paid within 5 days after the due date, the Tenant shall pay the Owner a one-time late payment charge of ₹500 for that month, as a genuine pre-estimate of the Owner's loss from the delay. This charge does not extend the due date or waive the Owner's other rights under this agreement.

Daily charge with a cap (sample)

If the rent is not paid within 5 days after the due date, the Tenant shall pay the Owner ₹50 for each day of delay after that period, subject to a maximum of ₹1,000 for any one month, as a genuine pre-estimate of the Owner's loss from the delay.

Interest on late rent (sample)

Rent not paid within 7 days after the due date shall carry simple interest at [__]% per year from the due date until the date of payment.

Worked example: rent of ₹20,000 due on 5 October 2026 and paid on 15 October is 10 days late. With a 5-day grace period and a ₹500 fixed charge, the fee is ₹500, which is 2.5% of the rent, or about 91% a year as an interest rate over the 10 days. With the ₹50-a-day clause it is 5 × ₹50 = ₹250. A short delay makes any fixed charge look large as a yearly rate, which is why a grace period and a cap help.

What makes a late fee look reasonable

  • It is written into the agreement both sides signed, before any rent is late.
  • It starts after a short grace period, not the day after the due date.
  • It is small next to the rent, and capped for any one month.
  • It is the same every month and applied the same way, with a receipt that shows it separately from the rent.
  • It is not a step-up in interest from the date of default, which section 74 itself flags as a possible penalty.

Better than a late fee: make paying on time easy

Most late rent is forgotten rent. A reminder a few days before the due date, with the exact amount and a way to pay in one tap, does more than a penalty clause, and it does not sour the relationship. Our rent reminder messages give you the words.

Reminders that go out before rent is late

Domvio sends each tenant a WhatsApp reminder three days before rent is due, with the exact amount and a UPI link to your own account, and a PDF receipt when they pay. Domvio does not charge, add or collect late fees; any late fee is between you and your tenant under your agreement. See the rent collection app.

Frequently asked questions

Is a late fee on rent legal in India?

Yes, if the rent agreement provides for it. Under section 74 of the Indian Contract Act, a court allows only reasonable compensation up to the agreed amount, so an excessive fee may be cut down.

How much late fee can a landlord charge?

No law fixes a number for residential rent. A small fixed charge or daily amount after a grace period, with a monthly cap, is easier to defend than a large one or a jump in interest from the date of default.

Can I charge a late fee if the agreement does not mention one?

No. You can claim the unpaid rent, but a fee needs a clause both sides agreed to. Add one at renewal if you want it.

Can I deduct late fees from the security deposit?

Only if the agreement allows deductions for dues under it, and with a written account. A disputed fee is better settled in writing before move-out.

Does Domvio charge late fees to tenants?

No. Domvio sends WhatsApp reminders before rent is due, with a UPI link to the landlord's own account, and PDF receipts. It does not charge, add or collect late fees.
