PG rental agreement format: what a paying guest agreement should include

By Giridhar Reddy, founder of Domvio, Bengaluru

A PG rental agreement is usually a leave and licence agreement signed with each occupant for their bed, not a lease of the room. It should set out rent per bed, deposit and refund timeline, notice period, lock-in, food, visitors, electricity and house rules. Have a lawyer adapt it, and stamp and register it as your state requires.

This is a sample for general information, not legal advice. Laws differ by state. It has not yet been reviewed by a lawyer. Have a lawyer examine it for your situation before you use or rely on it.

Is a PG agreement a lease or a leave and licence?

PG agreements are usually written as leave and licence agreements. The difference matters because leases and licences are covered by different laws and give the occupant different rights.

Lease and leave and licence compared, as they usually apply to a PG
Leave and licenceLease
What the occupant getsPermission to use the property, with no interest in it (Indian Easements Act, 1882, section 52)A right to enjoy the property for a period, which is a transfer of an interest in it (Transfer of Property Act, 1882, section 105)
Who controls the premisesThe owner keeps possession and control: shared rooms, common areas, staff, mealsThe tenant has possession of the premises let to them
Ending itA licence can generally be revoked, with a reasonable time to leave (Easements Act, section 63)Ends by the agreed term or notice; without one, section 106 of the Transfer of Property Act gives a 15-day default for a month-to-month lease
Fits a PG whenYou allot beds, can shift occupants between beds, and provide servicesYou hand over a whole flat or room for the occupant's exclusive use

In Associated Hotels of India v. R.N. Kapoor, the Supreme Court described a document that gives only a right to use property in a particular way, while the owner keeps possession and control, as a licence (SCC Online summary). Calling a document a licence does not settle the question by itself; what the arrangement actually gives the occupant matters. This is one reason to have a lawyer check your format.

Key clauses in a PG rental agreement

Sign one agreement per occupant, for their bed, even in a shared room. Each person then has their own rent, deposit and notice, and one person leaving does not affect the others.

Does a PG agreement need stamp duty and registration?

Usually it needs stamp duty, and whether it must be registered depends on the state and the length of the agreement. Check your state's current rules with a lawyer, the sub-registrar or the state registration portal before you sign.

  • Central rule for leases. Section 17(1)(d) of the Registration Act, 1908 makes registration compulsory for leases from year to year, for more than one year, or reserving a yearly rent. This is the reason often given for 11-month agreements. A licence is not a lease, but some states have their own rules for licences.
  • Maharashtra (Mumbai, Pune). Section 55 of the Maharashtra Rent Control Act, 1999 says every leave and licence agreement made after the Act began must be in writing and registered, whatever its length. The owner is responsible for registering it, and the penalty can include a fine of up to ₹5,000, up to three months in jail, or both. Stamp duty under Article 36A of the Maharashtra Stamp Act is 0.25% of the rent for the whole period plus a notional 10% yearly interest on the refundable deposit, as explained by Housing.com. Confirm the current calculation on the IGR Maharashtra portal.
  • Karnataka (Bengaluru). Stamp duty falls under Article 30 of the Karnataka Stamp Act. A 2018 table of Karnataka stamp duty rates lists 0.5% of the total rent and money advanced, capped at ₹500, for a residential lease of up to one year. Other guides we checked disagree on what the 0.5% is charged on and on the cap, so we cannot confirm the current figure. Check it on Kaveri Online or with an authorised e-stamp vendor.

We could not confirm every figure

Stamp duty rates and registration fees change, and the sources we found do not all agree. Treat the figures above as a starting point and confirm them before you pay. This page will be reviewed by a lawyer before it is indexed.

Police verification and ID for PG occupants

Collect an ID proof and photograph from every occupant at move-in, and complete police verification as your city requires. Rules and forms differ by state. Our guide to tenant police verification covers how it works.

Keep every occupant's agreement in one place

Once agreements are signed, the hard part is finding the right one when someone gives notice. Domvio's PG management software stores leases and KYC documents for each occupant, alongside their rent reminders and receipts. Domvio does not draft or register agreements. For larger buildings, see hostel management software, or compare the best PG management apps.

Agreements, KYC and rent for every bed

Store each occupant's agreement and ID in Domvio, send WhatsApp rent reminders with a UPI link, and give a PDF receipt for every payment. See our rent receipt format guide for what a receipt should show.

Frequently asked questions

Is a rental agreement required for a PG?

It is strongly advisable, and in some states, such as Maharashtra, a written and registered agreement is required by law for leave and licence arrangements. A written agreement is also your main evidence if there is a dispute over rent, notice or the deposit.

Is a PG agreement a lease or a leave and licence?

Usually a leave and licence, because the owner keeps possession and control of the premises and the occupant only gets permission to use a bed. Whether it is treated as a licence depends on what the arrangement actually gives, so have a lawyer check it.

Does a PG agreement need to be registered?

It depends on the state and the term. In Maharashtra, every leave and licence agreement must be registered. Elsewhere, central law makes leases of more than a year compulsorily registrable. Check your state's rules with a lawyer or the sub-registrar.

What stamp paper value is needed for a PG agreement in Bangalore?

Stamp duty in Karnataka is set by Article 30 of the Karnataka Stamp Act. Sources we found disagree on the exact figure for agreements of up to a year, so check the current rate on Kaveri Online or with an e-stamp vendor before you buy.

Should I make one agreement per room or per occupant?

Per occupant. Each person in a shared room should have their own agreement for their bed, with their own rent, deposit and notice period.

Can I use a free PG agreement format from the internet?

Use it as a checklist, not as your final agreement. Formats online often miss state rules on stamp duty and registration. Ask a local lawyer to adapt one to your PG.

Does Domvio create PG rental agreements?

No. Domvio does not draft, stamp or register agreements. It stores each occupant's agreement and KYC documents, and handles rent reminders, UPI payments and PDF receipts.
